Reform Support Team (RST) at the Ministry of Infrastructure of Ukraine (MoI), funded through the EBRD-managed Ukraine Multi-Donor Account,  is a group of Ukrainian professionals (non-civil servants) funded on a temporary basis by the donors that provides targeted technical support and assists in the design and implementation of priority reforms. The RST will assist in filling the capacity gaps in the design and implementation of priority reform strategies and programs, while strengthening links and partnerships between the Ministry´s priorities and relevant donor support.

Description of responsibilities and requirements to qualifications, skills and experience of RST positions at the Ministry of Infrastructure of Ukraine.

Position 1.

Project Manager: Inland Waterways Reform

  1. Objective(s) and linkages to Reforms

The water transport complex is a multifunctional structure that meets the needs of the national economy in transport. Marine and river ports are an integral part of the state's transport and industrial infrastructure. The competitiveness of the domestic transport system in the world market depends on the efficiency of the functioning of the ports, the level of their technological and technical equipment, the compliance of the management system and the development of the infrastructure with modern international requirements.

A Project Manager on Inland Waterways Reform is vitally needed to support the Government of Ukraine and in particular MoI in the fulfillment of the sector reform.

  1. Duration and proposed time frame:

Duration of assignment is 1 year (with discretionary extension for additional 1 year, also subject to availability of donor funding). This consultancy appointment is expected to start in January, 15, 2018 and has an estimated overall duration of 12 months. Subject to the availability of funding, the performance of the selected consultant and the specific needs of the RST, this appointment may be extended.

  1. Main Duties and Responsibilities:

Coordination and facilitation of reform implementation process

-    developing the inland waterways sector’s reform agenda and work planning

-    engagement of relevant stakeholders (experts, government officials, donors, etc.) to the RST’s activities

-    developing KPIs and monitoring and benchmarking for the sector efficiency improvement

-    monitoring the project implementation and preparing reports and presentations

-    contributing in the National Transport Strategy of Ukraine update and in the inland waterways reform work group

-    leading coordination of the technical assistance under Dnipro development Initiatives in the area of inland waterways

-    reviewing the existing draft law “On Inland Water Transport” with providing amendments to the draft reflecting best world practices

-    development of the proposal for sustainable sector financing (operations and investment)

-    other responsibilities as assigned by the RST Director

  1. Qualifications, Skills and Experience:

Qualifications and skills:

-    Bachelor’s degree in finance, economics, law, business administration, engineering

-    Strong organizational management, communication and presentation skills

-    PC literacy (PowerPoint, Project, Excel, Word; Visio is an asset)

-    Fluency in Ukrainian and English

General professional experience:

-    Preferably more than 10 years of professional experience (minimum 5 years)

-    Preferably 5 (minimum 3 ) years of experience in inland waterway or maritime sector

-    Experience in the transport sector related entities is an asset

Specific professional experience:

-    Proven knowledge and professional experience in public finance management is a plus

-    Experience with the reform implementation in Ukraine, especially as related to inland waterway or maritime sector is a plus

-    Experience with government entities and their mandate and processes is an asset

-    Experience in leading multidisciplinary teams is an asset

  1. Assignment Value

The estimated monthly value of this consultancy position is in the region of EUR 1,100 — 1,400.The funding source of this assignment is the EBRD-Ukraine Stabilisation and Sustainable Growth Multi-Donor Account. Please note selection and contracting will be subject to the availability of funding

6. Submissions

Submissions must be prepared in English only and be delivered electronically by December, 18, 2017, 23.59 EET

All submissions must include a completed Application Form and the CV, Reference Letter from a recent supervisor. Only applications which have been submitted using the correct template and are completed will be considered.

7. Selection Procedure

Following the evaluation of all applications received, selected candidates will be invited to a brief written test in Ministry of Infrastructure of Ukraine (Peremohy ave, 14) covering both general and technical questions in both English and Ukrainian. Short-listed candidates will be invited to interview. The successful candidate will be required to provide a written professional reference (original in English, or Ukrainian with English translation) together with the contact details for two further referees who can attest to the professional and/or educational background of the candidate. Successful reference check will be a pre-condition to contracting.

Position 2.

Legal Counsel: Privatization

(SOEs and Corporate Governance Reform / Sustainable financing for the infrastructural projects) Objective(s)

  1. Linkages to Reforms

The SOEs and Corporate Governance Reform aims at corporatization of the SOEs, as well as strengthening and advancing function of the ministry as a nominated shareholder. Planned milestones for this reform are:

- Developing ownership policy for the SOEs under the ministry

- Identification of a number of companies under the Ministry in need of corporatisation

- Developing a roadmap for corporatisation for selected priority SOEs under the Ministry

- Conducting a set of transparent competitions for appointment of directors of SOEs under the Ministry’s control

- Supporting corporate governance reform in accordance with OECD standards for the largest SOEs under the Ministry (Ukrposhta)

The RST needs Legal Counsel with strong qualification in private sector. The Legal Counsel will work across the entire sector including highways and road transport, rail, aviation and marine and ports.

  1. Main Duties and Responsibilities:

Facilitation of reform implementation process in the sector:

- Legal support of the transport reform process

- Contributing to deregulation and liberalization in the transport sector

- Analysis of the existing legal acts, carrying out gap analysis and preparing reports and summaries on any required changes

- participation in consultations and meetings with and to make presentations of proposed legal changes to the government and parliament of Ukraine

- Providing assistance to the Ministry and the relevant SOEs and authorities to address complex legal issues in connection with the above reform targets

- Contribution to the sector conferences and workshops

-  Preparation of draft bills and drafts of bylaws on amendments to current laws in the transport sector

- Implementation of draft bills, bylaws and legal support for enactment of draft bills and bylaws by the Parliament and the Cabinet of Ministers

-   Legal support of drafted bills and bylaws during their approval in the Ministries, Cabinet of Ministers, Parliament  and other state organizations

- Drafting of Ukrainian legal and sub-legal acts according to the EU-UA Association Agreement

- Other responsibilities as assigned by the RST Director and the Senior Project Manager on SOE and Project Financing

  1. Qualifications, Skills and Experience:

Qualifications and skills:

-          At least a Bachelor’s degree in law from the reputable Ukrainian or foreign University

-          Strong analytical, communication and presentation skills

-          PC literacy (PowerPoint, Project, Excel, Word, Legal databases Liga or Rada proficient)

-          Experience in high-level negotiations, strong communication and presentation skills

-          Strong analytical skills with the ability to interpret complex legal, commercial and financial information

-          Excellent command of English and Ukrainian, both written and spoken

General professional experience:

-          Preferably more than 10 years of general professional experience

-          At least 5 years of proven experience in leading law firm, public or business administration, consulting

-          General experience with other areas of transport law would be an advantage

-          Experience in providing legal support within at least one major completed transaction in private or PPP sector is a plus

-          Strong advocacy and liaison skills and proven ability to communicate with peers

-          Prior experience of work in public services reform team is a plus

Specific professional experience:

-          Proven knowledge and professional experience in project management

-          Familiarity with the reform agenda in Ukraine

-          Experience in leading multidisciplinary teams is an asset

-          Experience in infrastructure sector is an asset
