The submission of applications for the participation in the concession tender in the seaport of Kherson has started - Vladyslav Kryklii

Today, on October 8, 2019, the newspaper “Voice of Ukraine” published an announcement about the start of the submission of applications for the participation in the concession tender in the seaport of Kherson. The Minister of Infrastructure Vladyslav Kryklii has informed about it.
The concession object shall be the integral property complex which ensures the multipurpose provision of services in the Kherson Sea Port and includes assets of SE "KSCP" and assets of SE "USPA" according to the list approved by the grantor, as well as objects to be specially created (constructed) under the terms and conditions of the concession agreement. Concession based on results of the concession tender shall be granted for thirty (30) years.
«The applications to the participation in the concession tender shall be considered within 14 days, it is highly recommended to apply as soon as possible. The deadline for submitting applications to take part in the concession tender and concession tender bids is December 6, 2019. From December 6, 2019 until January 10, 2020, the changes to the concession tender bids are accepted (if there are any). After the submission of changes period is over the tender committee will evaluate the financial tender bids (from January 10 until January 20, 2020). The decision of the Ministry of Infrastructure on determination of the concession tender winner is expected to be taken in the second half of January 2020 (depending on the quantity and quality of the tender bids submitted)», - Vladyslav Kryklii informed.
Vladyslav Kryklii also noted, that after the determination of the concession tender winner and publication of concession tender results (tentatively in early February 2020) the Ministry of Infrastructure would proceed to negotiation and signing of the agreement with the tender winner. The agreement is expected to be signed in early May 2020.
The procedure for submitting applications to take part in the concession tender and concession tender bids is set out in the instructions for candidates available at the official grantor's web-site at https://mtu.gov.ua/content/proekt-koncesii-u-portu-herson.html.
Please note that the Ministry of Infrastructure prepared and sent information which is required for the applicants to obtain a concentration approval to the Antimonopoly Committee of Ukraine, including information on concession objects, the grantor and the business entities the assets of which will be transferred to the concession, in the amount provided for under the Antimonopoly Committee of Ukraine Resolution on the Procedure for Filing Applications with the Antimonopoly Committee of Ukraine for Obtaining its Prior Approval of Concentration of Undertakings, approved by the Ordinance of the Antimonopoly Committee of Ukraine of 19 February 2002 No33-р, registered by the Ministry of Justice of Ukraine on 21 March 2002 No284/6572 (in the wording of the Ordinance of the Antimonopoly Committee of 21.06.2016 No14-рп):
If the tender winner does not submit the document on the approval of the Antimonopoly Committee to the tender committee before the determination of the concession tender winner, he or she should, within one week from the date of publication of concession tender results, submit an application and the necessary documents to obtain such approval to the relevant body of that committee, in the procedure established by the Antimonopoly Committee. In this case, the decision on determination of the concession tender winner will be made after obtaining the relevant approval of the Antimonopoly Committee of Ukraine.
In the event that the tender winner provided (has not provided) a document on the approval of the Antimonopoly Committee to obtain a concession, within 50 calendar days from the date of determination of the concession tender winner, the grantor shall agree (reject) the decision of the tender committee on determination of the concession tender winner within a week after the receipt (non-receipt) of such approval.
If the tender winner does not submit the document on the approval of the Antimonopoly Committee to the tender committee before the determination of the concession tender winner, the decision of the Ministry of Infrastructure on determination of the concession tender winner will be taken in mid-March 2020, and the signing of the agreement with the tender winner will take place approximately in early July 2020.
